Enlightenment and Constitution Free Essays

Enlightenment and the Constitution The United States is a nation established in 1776 on a set of principles: liberty, equality, and self-government. These ideals derived in part from broad lessons of history, from the colonist, and treatises such as those of Locke and Rousseau. Liberty is a principle that individuals should be free to act and think as they choose, as long as their actions don’t infringe on the rights and freedoms of others. Self-government is the principle that the people are the ultimate source and proper beneficiary of governing authority. These principles were the foundation for the United States set forth and written by our founding fathers, but taken from rulers and minds of Europeans during the Enlightenment period. The Enlightenment was an eighteenth- century intellectual movement whose proponents believed that human beings could apply a critical, reasoning spirit to every problem (Hunt, Lynn, Martin Rosenwein, page 545). During this period the rulers, writers, and thinkers gave the back bone to the Declaration of Independence, the United States Constitution, and the Bill of Rights. Although before we get to this period and how it shaped the United States we will have to go back a little further to 1651. In 1651 an English philosopher Thomas Hobbes had his work Leviathan published. Hobbes argued that government rests on a social contract in which the people give up certain freedoms they would have in a state of nature in return for the protection that a sovereign ruler can provide. Almost a half of a century later, an English philosopher, John Locke, used Hobbes concept of social contract in his Second Treatise on Civil Government. Locke claimed that all individuals have certain inalienable rights, including those of life, liberty, and property. When people form a government for securing their safety, they retain these individual rights. However Locke saw the social contract a bit differently. The agreement to submit to governing authority is based on the premise that government will protect these rights, if the government fails to the people can overthrow the government and form a new one( Patterson,page 14-15, 30). Thomas Jefferson declared that Locke â€Å"was one of the three greatest men that ever lived. † Jefferson paraphrased Locke’s ideas in passages of the Declaration of Independence. Including those that, â€Å"all men are created equal,† that government derive â€Å"their just powers from the consent of the government,† and that â€Å"it is the right of the people to alter or abolish a tyrannical government. The Declaration was a call of revolution rather than a framework for government. However the ideas contained in the document: liverty, equality, individual rights, self-government became the basis for the Constitution of the United States (Patterson, page 30). In Voltaire’s, Treatise on Toleration and Jean Jacques Rousseau , Social Contract we find more Enlightenment thinkers ideas framed in the Constitution. The ideas the Constitution receives from these works are the basis for Amendment I, freedom of religion. Voltaire states in A Treatise on Tolertion,† Religion was instituted to make us happy in this life and in the other. † â€Å"Christians should tolerate each other. † â€Å"I, however, am going further: I say that we should regard all men as brothers, are we not all children of the same father and creatures of the same God? † Voltaire is setting the basis for freedom of religion, saying that the people must show Universal Tolerance for all. Rousseau takes it even further in The Social Contract. He states, â€Å"it is of importance to the State that each citizen should have a religion requiring his devotion to duty, however the dogmas of that religion are of no interest to the State. † Rousseau sets forth the idea that the government shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, as stated by the First Amendment of the Constitution. Finally Cesare Beccarria and Empress Catherine the Great both have an idea that resides in the Constitution. That idea is that all men are innocent until proven guilty. In Beccarria’s Crime and Punishment he states, â€Å"No man can be judged a criminal until he be found guilty: nor can society take from him the public protection until it have been proven that he has violated the conditions on which it was granted. Empress Catherine states in her Proposal for a New Legal Code in Russia, â€Å"No man ought to be looked upon as guilty, before he has received his judicial sentence; nor can the Laws deprive him of their protection when it is yet dubious, whether he is Innocent or Guilty?. We were given the assignment of creating an annotated bibliography of twenty pages. It was a group project and we were given the task of making annotated bibliography of different topics in the assignment. All the group members were given different sections of the assignment and they have to complete it at the assigned time. In addition, the team members also needed to make decisions regarding the roles assigned to different team members, how the team will communicate and complete the assignment. We also need to decide how disputes or conflicts can be resolved during the team progress. As stated above, there were five members in the group (Williams, Wooliams Spiro, 2012). All the team members were given different task and they have the opportunity to choose different topics according to their preference. However, we also decided that in order to maintai n the quality of the assignment and assure that the project is completed properly; we need to conduct regular team meetings. The group members can get feedback on their work and resolve any issue arisen during the completion of the assignment. According to the personal perception, this decision was beneficial and assisted us in making the best assignment. Analysis While developing the group assignment, we made several decisions regarding the assignment. We decided that the people should communicate regularly for the successful accomplishment of the project. While conducting the project, it was realized that there were some conflicts related to the content of the annotated bibliography. Although there was harmony between the team members, one of the team members was not satisfied with the work of another team member. It created issues between both of them. The team member performing the task was assured that his way of approaching the task was proper; however, another member was of the viewpoint that the problem should be addressed differently. We realized that the group would not be able to function properly if both the members will fight in such a manner. Therefore, it is important to intervene and take decisions to resolve the issue between different members. We analyzed the problem and understood that although the perspective of both the te am members was different, both the perspective were justified and correct (Bolton, 2014). Therefore, the second team member should be asked to back off and let the other team member do all the work. According to the personal perception, this decision was correct as it resolved the conflict and prevented other issues to be created in the near future. The functional group decision-making theory is an appropriate theory for the decision-making in a team. This theory emphasizes on a practical approach toward the decision-making so that effective decisions can be taken. The teams or the groups should try to create equilibrium between the job responsibilities as well as relationships between different members. A team can work effectively if different team members are able to maintain a harmonious relationship. Factors such as apology or friendship are important in maintaining a harmonious relationship. There are four basic functions in an effective decision-making, namely, problem analysis, goal setting, identity alternatives and evaluation and selection (Handler, Handler Gill, 2011). The problem analysis is the first function in an effective decision making and the group member looks at the likely causes of a problem. The group members must figure out what is the real problem in an organization and what are the symptoms of the probl em. Another phase in problem solving is goal setting in which the group members identifies what can be the possible solution for a problem. The group members identify what are the potential solutions for a particular problem. In this phase, the group members come up with as many solutions as possible; however, they stick with one solution. In the next phase, the team members identify the different alternatives. The team members find as many solutions as possible in this phase. Brainstorming is conducted to find the best solution; therefore, it is best to find the best possible solutions for the organization. The last phase of his model is evaluation and selection phase. In this phase, the team members of the organization evaluated each alternative and pick the best solution for the organization (Dainton Zelley, 2014). It can be critiqued that the current team undertook effective decision making process. The current decision making process aligned with the functional group decision-making theory. The group analyzed the problem of the conflict between two group members and found that the conflict arose due to the unnecessary intervention of different team members. In this regard, it can be evaluated that the team members need to resolve the issue by taking proper intervention steps. The team members understood the perspectives of different team members and tried to analyze the perspective of different parties. After thorough evaluation, it was critiqued that the intervention of another team member is creating issues in the work of other team members. Although the other team members were not having any problem with the first team member, they were also not happy with his attitude. Critical Discussion The decision-making is a complex process. There are several aspects to a decision and each aspect yields a different result. Although there are several alternatives to a successful decision, the selection of the right decision in important. In an effective and proper decision-making, the interest of all the stakeholders should be considered. There are several frameworks to analyze the efficacy of a decision. The eight-step decision making process is the best model for decision making. According to this model, there are eight steps in effective decision making. In the first step, the problem is defined. The problem definition is the most important part in effective decision-making, such as definition of root causes, identifying ant stakeholders issues and organization boundaries. In the second step, requirements are identified for an acceptable solution. Any acceptable solution to the problem should meet a certain criteria. The requirements to the solution must define what the solutio n may do. In the third step, the organization must establish goals for the intent of decision-making (Littlejohn Foss, 2009). The goals of the organization must be stated properly. In the fourth step, alternatives are identified for the organization. The alternatives should be able to change the initial condition of the situation into the desired condition. The different alternatives should be able to meet the initial requirements and goals. In the fifth step, a criterion should be defined to measure how each alternative is performing to achieve goals. The criterion should be able to complete, operational and precise in its judgment. It is important that the criterion has an input from the decision-maker and it should be able to accurately judge different alternatives. In the next step, the decision-maker selects the best-fit decision-making tool. The selected tool must be able to address the problem accurately. The selection of the tool is also dependent upon the complexity of the problem and the experience of the team. In the seventh step, the selected tool is judged according to the criteria. The alternatives can be judged according to the quantitative, qualitative methods or their combination. In the last step, the decision is evaluated against a problem statement (McKee, Kemp Spence, 2012). The solution is validated to ensure that it solves the problem identified. The original problem is identified in accordance to the goals and requirements. The decision of stop making people intervene in the work of others was effective in enhancing the overall productivity of the organization. The current decision was effective in improving the overall efficiency of the team members. The decision is evaluated in the eight step framework and it is deduced that the decision was effective in increasing the productivity of the organization. Recommendations It can be recommended that the effective decision-making is essential in the growth and progress of a team. It is important that a team has specific structure and format for the decision making. The decision-making framework will benefit the team players in taking good decisions. It is also important for the progress of the team or the organization. It is recommended that the team should ask for the participation of all the ream members in a decision. The process of brainstorming will effectively assist the team in gathering new ideas and innovative techniques for problem-solving. The organization should also identify the underlying or root cause of the problem so that the solutions can effectively address the issue. In the present case, all the team members actively participated in the decision making process. However, in order to pick the best solution for the problem, it is important that all the solution or the approaches should be judged according to the criteria. In the year 1948, the discovery of certain forces were indeed produced by placing non-magnetic material in a magnetic field, however they were far too minute to merit any serious consideration (Carthy 59). Some reports speak of heightened locomotor activity and heartbeat, when in close proximity to increased magnetic fields; a fact which might mean that a kinesis-based magnetism is a possibility. A study was done in which magnets were attached to birds and released in sunny (or starry) conditions have repeatedly been shown to have no effect on orientation (Dorst 24). However recently it has been shown that pigeons repeatedly released under conditions of heavy overcast (in areas where the recognition of landmarks could not rigorously excluded) have an orientation which is disturbed by magnets. Most workers with caged birds have failed to find any tracer of orientation in a planetarium with all the stars blocked off or in any closed room (32). This phenomenon definitely shows evidence that some if not all birds use celestial bodies. One group studying magnetic orientation in birds has consistently claimed to the contrary. Their accumulated data does seem to show some directional tendenci es but the scatter distribution is so wide that their significance could be said to be more statistical than biological. There are suggestions that there may be at least a north/south klino- or tropptaxis to the magnetic field. It must be remembered that no-one has yet been able to give the slightest indication of what the magnetic-sensitive organs are, nor whether they have sufficient acuity for us to be able to speak of a menotaxis, let alone orientation. By contrast, the birds eye is a very highly developed sense organ. Recent work suggests that European robins do not even detect north from the polarity of the magnetic field but from its angle to the horizon (43). Hypotheses that the earth magnetic field could provide a navigational grid date as far back as the work Viguier completed in 1882. The outcome of his work suggested that birds could detect and measure three components of the field, its intensity, inclination (the angle which a compass needle makes with the horizontal) and declination (the angle between magnetic and geographical north). These three components vary more or less with independence of one another so that their isolines would form a complex grid. Over the next few years, several different scientists restated this hypothesis, with minor variations. The complete lack of evidence for any direct reaction to a magnetic field in birds is a very questionable issue (Carthy 46). Can birds actually use magnetic stimuli as an internal compass? Well Casamajor (1927) and Wodzicki (1939) found that fixing magnets to the head of the Pigeon and the Stork, had no effect on their homing ability. There are many other theoretical difficulties that may provide an answer as to why the magnets did not affect the homing ability of the two animals in question (48). An important one is that measurement of declination requires an exact knowledge of geographical north. Elimination of the declination isolines from the magnetic grid reduces the plausibility of the whole scheme, since the inclination and intensity isolines generally cross one another at oblique angles making good fixes impossible (Lincoln 79). With these initial theoretical difficulties in mind the concept of direct sensitivity was therefore replaced by one of indirect sensitivity to the earths magnetic field, and the whole hypothesis was resurrected (Lincoln 89). Stress And Burnout In Criminal Justice Criminology Essay Comparison between Law Enforcement and Correctional. Stress and burnout occur in all different types of jobs and careers. However, some vocations are more prone to job stress and burnout than others are. Both police officers and correctional officers are exposed to work environments that are characterized by high levels of stress. Stress and burnout for both police officers and correction workers can greatly affect the field of criminal justice. According to Karen Hess (2009), stress can be both positive and negative, and this stress or excitement is why many police officers enter the law enforcement field (p. 464). Any given day, a police officer may have to shoot someone, be shot at, chase down a robber, deal with child abuse, and see death. Additionally, a correctional officer may also have to encounter a violent prison conflict or riot, encounter dangerous offenders and numerous other potentially dangerous situations. With the increasing prison population and never end sprees of crime, the stress for correctional officers and police officers is also increasing. Both law enforcement and the correctional field are widely considered some of the most stressful occupations, and both are associated with high divorce rates, alcoholism, suicide and other emotion and health problems. According to O. Ramos (2010), stress in the law enforcement field is unique because it is a constant factor with only changes in the degree and duration of the stress. Over the years, numerous research studies and projects have been performed to investigate how stress affects police officers and correctional workers physical and mental health by agencies such as the National Institute of Occupational Safety and Health and the National Institute of Justice. Through this research and studies, researchers have been able to indentify stress factors that are unique and more pronounced in these career fields, as well as their effects on the lives, jobs and the field of criminal justice. Stress can have numerous causes and can differ from individual to individual. According to Lambert, Hogan, Hiang, and Jenkins (2009, July), stressors are conditions that place excessive demands on an individual and can lead to discomfort, strain and conflict for the individual. While both the police officers and correctional officers are frequently faced with high levels of stress, the causes of the stress differ between the two groups with the job differences they face. Causes of Stress for Police Officers Issues in the officers personal life, the pressures of law enforcement work, the attitude of the general public toward police work and officers, the operation of the criminal justice system, and the law enforcement organization itself can all be stress factors for numerous police officers. According to Burke and Mikkelsen (2005), police stressors fall into two major categories. The first category stems from the nature of the job, and the second category involves the organizational aspect of law enforcement. The stress of the job involves the physical aspects of the job and includes threats, use of force, exposure to violence and danger, dealing with uncertainty, shift rotations, inadequate or broken supplies, low pay, excessive overtime, and constant fear of injury or death. On the other hand, the organizational aspect of law enforcement that contributes to job stress invovle the poor management, inflexible hierarchical structures, roles, inadequate communication, and organizational structure (Burke et al. 2005). In fact, Burke et al. (2005) discusses how the bureaucratic nature of the law enforcement organization obstructs police officers from feeling as if they have input in changing the policies sand procedures. There is also conflicting policies, poor supervision, and endless rules that create a tense and stressful work environment. McCarty, Zhao and Garland (2007) also discuss how job stress can differ between male and female police officers. For instance, female officers may be subject to gender discrimination from male officers and supervisors, which could increase their job related stress. Female officers also feel additional pressure that they have to prove themselves more on the job, as well as feel their male partners provide inadequate backup and question their abilities more frequently (McCarty et al., 2007) Additionally, individual stress factors can play a factor in a police officers stress levels due to their personal life. Some individual stress factors include family problems, financial problems, health problems, and taking on a second job for extra income. In fact, many officers are willing to put their health at risk for overtime or another job for the additional income (National Institute of Justice). Causes of Stress for Correctional Officers Correctional officers face some of the same and similar job stressors as police officers as well. Correctional officers have to deal with the never-ending demands of inmates. Correctional officers are also responsible for large array of responsibilities and duties to ensure the correctional facility is properly maintained in an organized manner. Aside from police officers, the workplace nonfatal violent incidents are higher per 1,000 employees for correctional officers than any other profession (Finn, 2000, p. 2). Additionally, according to Childress, Tallucci, and Wood (1999), while a correctional officer operates in a high stress work environment much like a police officer, there have been minimal examinations of the correctional environment in comparison to the voluminous research conducted on the causes and consequences of stress for law enforcement officers. However, it has been determined that some of the job related stresses include inmate demands, low pay, excessive overtime, poor public image, shift rotations, threat of violence, understaffing, amount of contact with inmates, role ambiguity, role conflict, and role overload. The major forms of stress in the work environment can be categorized into organizational structure and job characteristics (Lambert, Hogan Allen, 2006). According to Lambert et al (2006), organizational structure deals with how an organization or agency is arranged, managed and operated, and it normally throughout the entire work environment and therefore influences all employees that work there. Lambert et al (2006) cite a study by Stohr, Lovrich and Wilson that the lack of participation in decision-making caused increased stress for correctional officers. Additionally, the lack of control over the work environment due to the centralization of decision-making can increase the levels of stress. In fact, Lambert et al (2006) performed a study at a Midwestern correctional facility that showed workers who perceived a lack of input into decision- making or a lack of job autonomy had increased levels of stress. Furthermore, lack of information or being kept in the dark is another stress factor for correctional staff caused by the organization structure. Inadequate communication about their jobs is major stress factor. Correctional staffs need clear communication about their tasks, jobs, and issues in order to complete their job and be an effective member of the organization (Lambert et al, 2006). Additional organization-related conditions that can cause increased stress for correctional officers are understaffing, mandatory overtime, understanding, and unreasonable demands. Finn (2000) describes how understaffing can create different types of stress such as lack of time to complete tasks, overload of work, apprehension, and inability to get time off (p. 12). Understaffing also causes the need for extensive overtime from the correctional staff. On the other hand, there are job characteristics that cause stress. Job characteristics are specific to certain jobs; therefore, they are not always found throughout the entire field. Job related stressors included the threat of inmate violence, inmate demands, and problems with coworkers. Lambert et al. (2006) identify some job characteristics as job variety, skill variety, role conflict, role ambiguity, task significance, task identity, and supervision. The roles that correctional officers have to assume can create considerable stress for the officer. According to Lambert et al (2006), role strain is liked to increased stress and role conflict occurs when behaviors for a given job or position are inconsistent with another. Correctional officers also face stress from outside sources other than the prison or jail that they work at. One cause of outside stress is their public image. A lot of the time correctional officers or prisons and jails in general are portrayed in a negative light. This negatively comes from the fact that many people do not know or understand the role and jobs of correctional officers. Sometimes this negatively even forces correctional officers to discuss or talk less about their jobs with others. Another outside source of stress is their pay. Propaganda, Patriotism, and the War on Terrorism On college campuses across the nation, efforts are being made to silence professors who encourage students to probe the history of U.S. foreign policy in the effort to understand the September 11th attacks. Recent articles in The Chronicle of Higher Education report that students have complained to deans about professors critical of U.S. foreign policy, and boards of trustees, deans, and college presidents have drafted resolutions and issued public statements condemning their views. Professors have been shouted down, received volumes of hate mail and, on some campuses, death threats. In one case, a trustee publicly invited a professor "to take a hike." Historically, such attacks on free speech have risen sharply in times of national crisis -- precisely when a full range of views is sorely needed. They are particularly disturbing on campuses of higher education that should be strongholds of people who defend independent thinking. The nature of the arguments offered against these dissenting voices are very troubling; so too their political effects. The arguments fall into two groups. First, professors are charged with showing no concern for the feeling of others: they lack taste and judgment; they are insensitive, self-indulgent and offend others at a time when emotions are raw. In being so inattentive to their students' emotional sensitivities, dissenting faculty violate the trust students place in them. Now is not the time for critique, but for emotional nurturing, reassurance and national solidarity. Second, professors are charged with offering excuses for the attacks. Their examination of the role the United States may have played in creating conditions that make terrorist acts more likely amounts to a justification of the acts themselves. There is an emotional tyranny at play here, and its effect is to obstruct processes of understanding that alone will aid us in our ongoing debate over how to come to terms with terrorism. What do I mean by tyranny? In the first instance, we are being told that feelings alone are appropriate now. It is too early, indeed, it is tasteless, to begin to sort through our role in the complex factors that brought these people to their heinous acts. But understanding is crucial to wise action, and action, as we see in each morning's news, is most certainly being undertaken in our name. While we are being asked just to feel, the administration and its congressional allies hurry to pass laws that threaten our civil liberties at home, and engage in a massive war effort likely to foster greater resentment abroad.

The death penalty is something that many people do not have a clear decision on. Many people support the death penalty, while others wish for the death penalty to be abolished, yet there are some that support the death penalty, but only in certain cases. My personal opinion is that a person commits murder and is sentenced to death there should be no waiting. I believe 24 hours from the time the person is sentenced to death, the state should follow through with their punishment and execute. There are people in the world that support the death penalty and often say that the death penalty is a deterrent for future criminals who are thinking and plotting out their heinous crimes or murder as we sit in our living rooms right now. Capital Punishment does not act as a deterrent force. Crime rates do not decrease in states where capital punishment is used. This statement can be neither proven nor disproven. How do you measure the amount of people who have been deterred from crime? Do you take a poll? Is there a survey conducted where people voluntarily admit they would have murdered had they known they would not be executed if they were caught? No. You can’t prove that it deters crime. So, even if it does, there is not enough evidence to support this theory. Do you agree with this statement? For me, when I think of a criminal they are not thinking of consequences of their actions, they are not thinking of whom they are going to hurt, they are only thinking of getting what they want. They think in the â€Å"Now†, they simply just do not care. If they had any sort of emotion or remorse before the crime is committed then our prisons wouldn’t be so over populated as they are today. Amnesty International, which opposes the death penalty, reports that scientific studies have not produced any conclusive evidence showing that capital punishment, is a deterrent for future crimes to be committed. I believe the only deterrent for a murderer not to commit a horrific crime again would be execution. Executing a dangerous criminal ensures that he will not kill again. There have been several notable cases where men were paroled, or escaped from prison after being convicted of murder and killed again. The death penalty protects our community by eradicating a harmful criminal from society. A few good examples are Randy Greenwalt, Arthur Shawcrossm, Kenneth McDuff, and  Daniel Camargo Barbosa. Various people who are opposed to the death penalty say that Capital Punishment condemns the innocent to die. According Amendment V in the United States Bill of Rights, â€Å"No person shall be held to answer for a capital crime, or otherwise infamous crime unless on a presentment of an indictment of â€Å"grand jury†. While it is true that a few innocent people have â€Å"slipped through the cracks† of the justice system and been convicted and executed unfairly, it   is extremely rare. Usually, attorney’s find new evidence to support a criminal’s innocence by the time all appeals have been exhausted. Perhaps the most important factor in determining whether a defendant will receive the death penalty is the quality of the representation he or she is provided. Almost all defendants in capital cases cannot afford their own attorneys. In many cases, the appointed attorneys are overworked, underpaid, or lacking the trial experience required for death penalty cases. There have even been instances in which lawyers appointed to a death penalty case were so inexperienced that they were completely unprepared for the sentencing phase of the trial. Other appointed attorneys have slept through parts of the trial, or arrived at the court under the influence of alcohol. FACTS ABOUT ATTORNEY S AND THE DEATH PENALTY: †¢Almost all defendants who face capital charges cannot afford an attorney and rely on the state to appoint one for them. However, often times appointed attorneys are overworked, underpaid, lack critical resources, and are either incompetent or inexperienced. As a result when death sentences are set aside by the federal courts, it is often because among other reasons the trial attorney was so incompetent that the accused’s constitutional right to effective counsel was violated. Special Rapporteur on extrajudicial, summary or arbitrary executions conducted an official visit to the United States to examine the administration of the death penalty in Alabama and Texas. Alabama has the highest per capita rate of executions in the United States, while Texas has the largest total number of executions and one of the largest death row  populations after California and Florida. The Special Rapporteur expressed concern about deficiencies in the administration of the death penalty in Alabama and Texas, including â€Å"the lack of adequate counsel for indigent defendants.† He called for the two states â€Å"to establish well-funded, state-wide public defender services† and recommended that â€Å"oversight of these should be independent of the executive and judicial branches.† The state of Alabama has no statewide public defender system even though its death row occupants are overwhelmingly poor with 95% indigent. †¢An examination of 461 capital cases by The Dallas Morning News found that nearly one in four condemned inmates has been represented at trial or on appeal by court-appointed attorneys who have been disciplined for professional misconduct at some point in their careers. †¢An investigation by the Texas Defender Service found that, â€Å"Death row inmates today face a one-in-three chance of being executed without having the case properly investigated by a competent attorney and without having any claims of innocence or unfairness presented or heard.† †¢In North Carolina, at least 16 death row inmates, including 3 who were executed, were represented by lawyers who have been disbarred or disciplined for unethical or criminal conduct. With all this being said regarding lawyers and the accused what do you think? Do you think if the accused had an expensive attorney that they would not be facing the death penalty and get life in prison instead? I guess that this is a question that we all would love to have the answer to. As they say money makes the world go round. Think of all the costs that are involved with the death penalty. Tax payers pay to house, cloth, food, and the medical bills alone for this one inmate will cost us millions. All the millions of dollars that are spent on this one life can be used to better our communities, or schools, educate our children, who are our future. We should stop wasting money on rehabilitation for these inmates, and put the money into what is important, our children, the future of The US. I fully support the death penalty, it makes me so upset to think back to the Cheshire, CT murders, the amount of money spent on two men who were caught at the scene of the crime, confessed to murdering an innocent woman and her kids, and beating her husband almost to death.  They should have been executed the day after they committed that horrific crime. Instead, the government wasted and is still wasting millions of dollars on two criminals who do not deserve to see the light of day. Something needs to change in our government. I believe Connecticut should be more like Texas. A state that enforces Capital Punishment to the fullest. Enough is enough! Criminals should not be running our lives and getting away with murder, literally! In conclusion, after reading all the facts stated above, how do you feel about the death penalty? Do you think we should be paying for these criminals to live in prison with a meal, a bed to sleep in, medical attention, and clothes on their backs? In my opinion the answer would be, no. The Residency Application Process In the residency application process, the personal essay plays a tremendous role. As a resident in a hospital, you will no longer be attending medical school classes but actually working as a doctor with live patients. That being said, residency directors want to know as much about your personal beliefs and character as they do your education. Egyptian Style Essay â€Å"Egypt has long fascinated the west. † This couldn’t be more true. Egyptian art can be said to be one of the most significant periods in art history. Their modern advances in such a far time ago were made unknowingly and helped shape art to what it is today. By just looking at it, Egyptian art may not come off as amazing as it actually is. One must dig deeper. The artwork they were creating wasn’t always made to be art. Instead, it was mainly made for religious purposes. Anything they created was being made to be symbolic in a religious view. They decorated their temples with paintings and statues in the belief that doing this served the gods, showed devotion to the king, and maintained the order of the universe. There was much more involved in the artwork, or craftwork of the Ancient Egyptians. They created their own style that everyone followed, and it reoccured through many periods of Egyptian history. Styles can range from abstract to realism, expressionism to surrealism. But in order to understand these styles, one must need to know the true definition of style. When used in describing the history of art, style usually refers to a characteristic, or a number of characteristics that we can identify as constant, recurring, or distinct. In art, the sum of such characteristics can be associated with a particular artist, group, or culture, or with an artist’s work at a specific time. Ancient Egyptian art forms styles were just that. They are characterized by regularity or consistency and detailed depiction of human beings and the nature. Artists wanted to preserve everything of the present time as clearly and permanently as possible. Completeness took precedence over prettiness. These forms and art styles present an extraordinarily vivid representation of the time and the culture, as the ancient Egyptian life was lived thousand of years before. Egyptian art seemed to obey one law. The mode of representing man, nature and the environment remained almost the same for thousands of years at that time, and the most admired artists were those who replicated most admired styles of the past. A Shabti is a small human figure representing a person who would perform a given task for the deceased in the afterlife. Described as funerary figurines, these figures were costly items produced for the privileged people. The wealthy nobles and royalty did not plan on doing any work themselves, so they would take their symbolic servants with them. Shabties were made from various materials including; faience, wax, clay, wood, stone, metal and other minerals. The Shabties observed, were from the time of 1932-1759 BCE. Covering the period of the Middle Kingdom. They all seemed to be very similar by the way the were posed with their arms crossed and standing up. All their facial expressions seemed to have the same appearance as well. The painting or carving of the writing all looks similar but once looked at more closely to see the details, the the amount of time put into the pictures and writing can be seen. Many of patterns include lines drawn on the clothing. Also the figures were called upon to carry out the tasks in the after life. To do so the Shabti was supplied with miniature agricultural tools to fulfill these tasks. Which can be seen when looked at very closely. What makes them different from each other is the medium they were created in. The faience figures are a blueish to light green color with most of the writing carved into it. The wood Shabties are painted over to be any color, sometimes even with golden leaf. To call these figures a type of object is correct. They are all objects that can be seen and once were touched and made. They all are this same type of object because even though they were made at different times and in difference places in Egypt, they all still are seen today. If the Shabties were not grouped together, being able to recognize them separately would be just as easy. They are very distinct figures by their size, silhouette and detailed writing. Being able to be recognized Ancient Egyptian Shabties when separate and still look appropriate when together is one of the style characteristics Egyptians were able to create. The similarities in the each other figures, is the characteristic of being consistent. How each statue was placed in the glass case, they almost seemed to be grouped. Beginning with the alabaster, the two figures were both of medium size and couldn’t make out much of the writing on them. The next grouping was ones made of limestone. With these three figures grouped together, one could see how they were created by the same artist following the steps of the first. The largest of the bunch was the limestone, Coffin of Luy. This was different from most in the collection since it was an actual open figure, but still had a reoccurring pattern like he other figures. The next grouping, The Three Shabties of Setau, were made out of wood. These were the most colorful, since they were all painted. They seemed to still be like the older figures but made in a newer and more decorated way. The figures made of faience varied in size, some only a few inches. They were either carved in or has black paint writing on them. As seen, there is a large variety of Shabties, yet the sense of style kept between was able to pass along through hundreds of years. The one Shabti that stood out to me was the, Shabty of Sati. New Kingdom, Dynasty 18, Reign of Amenhotep III 1390-1352 BCE. It was made out of faience, but wasn’t the common green-blue color. It had the most different colors all painted on it. Including red, blue, yellow, and green. The whole figured wasnt painted so the faience material could be seen. What drew me to it at first was that it was in a case of its very own. It was in the same pose as the other figures but this one looked very well preserved, not smudged or chipped like many of the others, so it stood out. The combination of the paint and grey made it very unique to use both materials. The style of this figure very much goes with the rest of figures. As stated earlier, the most admired artists were those who replicated the most admired styles of the past. With this figure since it was a later on piece, it seemed to still associate with the same characteristics of the past Shabeti figures. Ancient Egyptian artwork was not meant to be artwork at first. Religious meanings and symbols were the priority. Everything was for the god’s and what would come in their life. But from these practices of art, they created a style of their own. Style in relation to art history, usually refers to a characteristic, or a number of characteristics that we can identify as constant, recurring, or distinct. In art, the sum of such characteristics can be associated with a particular artist, group, or culture, or with an artist’s work at a specific time. The culture of Egyptian art was to keep the process constant of the same kind of art. And as time passed, even if some characteristics changed, the main style recurred somehow. The Shabeti figures did that, and once studied upon more, most of Egyptian art will be styled in the same way, shape, and form.

Theory of Consumer behaviour and decision making The decision making theory was examined and modified by Nicholas Bernoulli and Oskar Morgenstern but it originate about 300 years ago. The theory was based on the expectation of decision outcomes which was a cognitive process. Later the theory was modified with the addition of value and satisfaction. In addition Allen Shocker explains the complexity and steps which involve in decision making. (Michael Richarme, 2005) Degree of involvement is another important factor while looking and making decision. Researchers also proved that the marketing activities have huge impact on consumers psychology which helps to take decision. Consumer behaviour is a psychological function which involves the customer to undergo the identification of their needs, searching methods to fulfill the needs and make purchase decisions accordingly. The process can also be described as collecting, interpreting, making plans and executing it for successfully buying the desired product (Lars Perner, 2008). The behavioral approach of the consumer is highly dominated by their psychology. The stimuli can either be intra or inter personal from the consumer. This can further be explained by the BLACK BOX MODEL which emphasizes on the connection between the response and the stimulus of the buyer. (Cindy Dietrich, 2010) The companies plan and process their marketing stimuli, whereas on the other hand social factors like political, economic and cultural, impact the environmental stimuli. Internal and external factors have been represented in the model as buyer characteristics and environmental stimuli respectively. These factors together influence the decision process and buyer response as described in the figure above. From the identification of problem till the post evaluation of the decision each step is very critical for the buyer which directly affects the marketing strategies. Positive learning reduce the steps in decision making where consumer narrow down the choice, information search, alternative, here consumer behaviour to buy the specific product. All these process relate to buyer psychological factors, motivation, learning, personality etc. on the basis of information gathered the buyer tries to select the best available option while making the purchase. Origination and influence of learning on buyers behaviour The cognitive method is the greater part of mental psychology which founded by early Marketers back (360 B.C). The memory or learning theory was developed by Aristotle who linked learning and knowledge as a mental process. In 1950 Hubb developed a model called Stimlus- organism- response which was dominated by behaviorism approach. (Hope J. Hartman,2001) Consumer decisions are influenced by individual uniqueness like age, life style, self concept, personality, occupation and economic condition. The purchase decision also influenced by individual learning and past experience. (Kotler, 2006) Learning refers to actions performed or information received. It arises from experience and interplay of wants, stimuli, response and reinforcement. Once the consumer has learned from their experience they try to discriminate and recognize the difference between similar buying stimuli and adjust their response to it consequently. Learning theories are also important to marketers in order to create the demand for a product using the buyers knowledge, motivating reasons for purchase and also backing them up with positive reinforcement (Frans Giele, 2009). Learning evolves over a period of time and helps the consumer to improve their knowledge. There is a continuous impact on the behavior of the consumer and their purchasing activities in future. The information gathered using different learning processes help the consumers to create a guide and mental framework for their purchasing pattern, behavior and decision. Learning is also closely to perception as it serves to be the raw input for the consumer knowledge which they have gained from previous buying occasions. (Mario Glowik, Slawomir Smyczek, 2011). Perception can better be explained as a process which the consumer uses to select, organize, receive and interpret their buying need and enrich their learning for a better purchase decision. (William j. Mcguire, 1976) said that perception is more important and has high influence than other stimulus. In this way the consumer evaluates the various brands and products which come to their mind. Often the compared aspect of the product relates largely to the psychological and functional benefits offered by the products or brands. (Thomas M. Aslin, Michael L. Rothschild, 1987) Marketers must understand the importance of learning/ experience as first impression is the last impression and it is important for the company to retain the existing customer as it is always cheaper and consecutively make new loyal customers. Other market factor like service quality and sellers eminence are also a part of human cognitive process which directly affects the buying pattern. (Kau, Daleen and Serene, 1995) New marketing strategies should focus to enrich customers experience by enhancing their learning/ experience and benchmarking those processes to increase market segment and share. Mental learning determines that for how long does particular information retains in human mind. This process involves different activities that a consumer relates while buying the particular product or service and then this information becomes the knowledge for future reference. Consumer retrieves the information from the memory if the same or similar product or service is observed. Effective marketing strategies and tools help to create a lasting impact on the cognitive learning of the consumers. (Mark D. Uncles, Grahame R. Dowling, Kathy Hammond and Angelo Manaresi, 1998) Marketers can use behavioral learning to enhance the consumers experience associated to their products as a large market segment loves to follow the current market trend and feel satisfied with their decision. Example 1: Dettol antiseptic has excellent advertisement which has made a lasting impact on consumers mind by using their marketing slogan of Be 100% sure. This advertisement has created a long and positive image on consumers mind since ages. Even after the launch of other brands of antiseptic liquids like Savlon by JJ, consumers still look for Dettol as their first choice while making a purchase decision as Dettol has made a strong brand image. Example 2: Allen bought Mercedes Benz S-class and told his boss and the boss admired the comfort, safety and power while driving, he will be happy to hear positive response and feel satisfied with the buying decision and feel proud to associate with the brand. Service products require more concentrated and customized service and experience. As they affect each customer in different manner and individually. Consumers level of involvement influences their buying behavior decisions which can be classified into three categories: Repetitive/routine buying, limited and extensive decision. Level of satisfactions/learning is also important to decide the nature of buying behaviour in future. Consumers keep their learning experiences as a catalogue and categories them as positive or negative which they use for future reference. Example 3: A Toyota customer will remain loyal to the brand if he has a good experience with his previous purchase of its models and associated services. So when the company introduces new car segment like Lexus which belongs to niche market, the customer will not hesitate to buy the product since his experience is affirmative. 2.0 B: Why is customer experience important to marketers in explaining buyer behaviour? Consumer behaviour and decision making process has been one of the favorite research topic for marketers since ages. Authors like Sheth (1974) recommended that consumer decision making is largely influenced by their family, awareness, knowledge and power of their attitude for the brands available in the market. Consumers use detailed information and their past experience to minimize brand ambiguity. Therefore managers must ensure that each purchase experience leads them to higher satisfaction and positive learning about their product and brand. Allen m. Weiss, Nicholas h. Lurie, and Deborah j. Service quality has emerged as an influencing characteristic in consumers learning, as a goods service quality leads to positive learning and rewarding experience for the consumer. Example 4: Dell is famous for their products and after sales services. In case of any technical assistance needed, the company sends their team to solve the problem at the customers residence. So the customer is highly motivated to trust and buy their product. Dell used customer experience and feedback to improve their product and service quality. 2.1 Explanatory examples (Marketing and Managerial Implications) 2.1.1 Dettol (Reckitt Benckiser) Strong marketing and brand image is behind the success of Dettol. Marketers have carried extensive research, advertisement and learning campaigns. The company has focused to educate and make every single consumer aware about personal hygiene and germ free environment. The marketing slogan of Be 100% sure has created a positive image and brand in consumers mind. The cognitive learning has helped the company to influence the buying behaviour and decision making of the consumers. Dettol has used several marketing strategies which were designed to influence the learning of consumers to ensure that whenever they think of antiseptic liquid they must think of the only brand i.e. Dettol. Through the use of learning and awareness programs, the company has successfully expanded their business and product categories from personal care to total care. E.g.: They first launched their antiseptic liquid followed by toilet soap, hand wash, shower gels and bars, shaving creams etc. Dettol has used mar keting knowledge and communication to develop the need of the product which was supported by various marketing and advertisement programs. Sayantani Kar, (2009) mentioned that Consumers are highly influenced with learning approach adopted by Reckitt Benckiser hence they are loyal to the brand. Dettol marketers have chosen psychographic and behavioral segment to target the selected consumer and then penetrate by the use of marketing channels. Competitive marketing and advertisement is the powerful USP (unique selling proposition) which helped them to grow and develop strong image which directly influenced the buyer behaviour. By using cognitive and behavioral learning factor company is rapidly engaged in research and development to extend its product line. (Prerna Raturi, 2006) Several business rivals like PG, Unilever have tried to focus on consumer learning and succeeded to break the market to some extent but being a pioneer and strong brand, Dettol remains as their first preference. 2.1.2 Lexus (Toyota Motor Corporation) Being an automobile market leader the company has transformed itself into quality conscious company. Toyota is well known for its durability, performance, luxury and features. Consumers have learned the superior quality and performance by experiencing Toyota cars. Company has a wide segment market which starts from middle income to high income groups. Toyota has transformed high end market with clever marketing and using consumer experience. (Bill Vlasic, 2012) Through encouraging experience they have entered in to niche market where traditional rivals like, BMW, Benz and Volvo dominate the market. By understanding the need of their existing customers they took innovative steps and broke the market share and successfully launched LEXUS. Lexus is a premium car and also one of the largest selling brands in the world. Carl Howe (2007) mentioned that Lexus used direct and target marketing by which they targeted loyal customers who were happy with Toyota models, while they carried massive marketing plans to focus and educate the consumers that Lexus belongs to Toyota but it is a more value added product. They used words like same family but different child concept to introduce Lexus. The new concept was high value leading to high price which influenced buyers to experience the new product. Consumers have responded greatly to the new model which resulted in greater sale for the company, since the cognitive learning was affirmative which insisted them to try the new model Lexus hence upgraded their behavioral learning. Alan Ohnsman and Makiko Kitamura (2011) stated that the after sales service was one of the key marketing features together with the product that enabled the marketers to develop lasting impact on consumer psychology and they succeeded to influence buyers behaviour. (C) Best product category and its implications. 3.0 Financial Services (Banks) Financial services are the most discussed topic in todays economy. By narrowing to financial products like, Personal banking and Investment banking particularly, service marketing has introduced many models to understand and deal with the problems. Consumer behaviour is one of the biggest issues which differentiate these two markets (product, service). Services are different from goods because of their heterogeneity, inseparability, intangibility, perishability and customization which make it difficult for marketers to identify and practice the service standards. Major Banks and financial institutions have realized the importance of consumer psychology toward financial products which influence the final decision. (McKechnie, Sally, 1992) To make a purchase decision for a financial product the consumers are not completely aware of the utility and consequences, the learning is developed simultaneously with the product use and Therefore its highly critical for the marketers to acquaint with personality, consumer thinking, relationship, service quality etc. which directly affect the buyer preference. The financial services are not a one- time purchase but there are several two- way transactions for long time. These services need the trust, confidence and mutual rapport of the consumer in the financial institutions. Lunt, Peter, (2005) explains that Marketers invests plenty of time to facilitates and establish a mutual relationship to print positive image in the consumers cognitive learning which they consider to assess the creditability of the institution repeatedly. It also benefits the institution in long term business with individual consumer. Trials are not available for these products and services, most of consumers use their experience to make decision every time. So customer experience, trust and brand image are the main wisdom drivers which influences the buyer to select from available financial facilitators. 4.0 Conclusion The object to study the consumer behaviour and decision making is to examine the role of determinates that influence the final decision of consumer. The justifications and explanation was based on available consumer decision making theories, buying behaviour model and deep study of selected determinant learning. While exploring the determinants it was observed that marketing stimuli, an external and internal factor plays a critical role in consumer psychology which influence individual response. These elements affect the final purchase of every single product or service. Therefore its highly critical for the marketers to identify and effort to narrow down the difference between consumer and supplier interest. Study also indicates the major difference between product and service and also suggests addressing them with more focused marketing. As a service based product buyers are more conscious about the cost and outcome of the specific product because of intangibility of the product it is difficult to communicate with the consumer. Learning encourages the buyer to understand and provide a clear feedback of any particular product. If the consumer is happy with the product or service the feedback will be highly positive which also influence the buyer to straight rebuy without considering other options. In financial products consumers are always scare with the outcome of the decision and highly depend on their previous learning. Marketers have used this element to understand the needs and want to optimize the satisfaction level, which is actually developing positive attitude to rebuy the same product. Marketers can use modern methods to reduce the level of negative out come by spending more on developing consumer learning and experience. The right use of service quality, customer relation and satisfaction helps to create long term business with every customer which also reduces the brand switching. It is also observed that companies and marketers cannot solely depend on learning determinant. While investigating the determinants it is seen that marketing stimuli also affect the buyer behaviour. The choice of marketing mix product, place, price, promotion) significantly changes the taste and choice of buyer. Marketers must design the strategies to reduce the flaws and ensure that the right message is conveyed to the consumers. The primary aim of marketing is to develop the need, attract, educate and influence consumers to buy the product. Therefore proper market study, product design, segmentation and targeting should be ensured by the marketer. 5.0 Learning from the assignment Consumers involve in buying and decision making process every day. The learning and decision making affects every time one use the product or service. Being continuous process its crucial for the buyer and the marketer to understand the process behind the decision process and what factors affect the buyer on each purchase. Being a marketing student the assignment helps to understand the available theories in details. Exploratory assignment determinants of buying behaviour helps to comprehend the practical implication of each determinant like Marketing stimuli, external and internal factors. By using exploratory research on chosen factor it was observed that it is very critical for the company and the marketer to understand the consumer need, preference, satisfaction and loyalty. Companies cannot rely on each determinant which influences buyer decision because consumer keeps changing their buying decisions. Strong marketing is also one of the key successes for every company which involves more focused, targeted and innovative communicative tools to address the need of the consumer with offered solution. Assignment also facilitates to analyze the practical illustration from the world renowned companies. While exploring their marketing strategies particularly which helps to learn from their practices. Critical analysis help to understand the pros and cons of every option which the marketers use address the problem. The assignment also encourages self learning, theories and their implications. Being a future manager it is quite helpful to discuss and address the problem in details. The positive outcome is to address the problems with solutions which help to groom the thinking and brainstorming process being a decision maker and manager.
